I'd say at least a 10 gallon pot.

if i cant transplant it, will there be any problems? from what i heard it will only reach a certain height with a certain size pot

Sure it will limit how big it will get. But once it starts flowering, you will have to water it a couple times a day. That will be a big pain in the ass.
Why wouldn't ya transplant it?

then ur better off putting it in the ground. if u can't handle bringing a larger pot out how do u expect to water it. like hawk said man.....a pot that size will need water constantly.
a heavily root bound plant on a hot summer day will be dead in no time.
that plant looks healthy man. you've still got time to transplant and do some training. get on it

damn thing is i cant do that either since the soil from the ground has too much clay and rocks...and doesnt seem suitable for growing

Then you dig a big hole and supplement with bagged soil. You will have to do this. Otherwise you're plant is destined for failure.

what ive decided to do is get one of those 5 gal home depot buckets and transplant it into that, since that is the most i can do at this point

now start some training. not sure if you've come across it yet, but there's a thread stickied in the mj cult forum that goes into great detail about the few different ways to train and increase yield.
