lease agreement vs grow op (cali)
    #180432 - 01/12/09 09:55 PM (7 years, 10 months ago)

does a medical user have a right to grow his medicine in his apartment, or could a property owner make this illegal through the lease agreement.

also how probable is it that a fully legal medical grow gets busted by landlord?

The landlord has the right to make it illegal for you to grow in his home. Just ask if its ok or just dont let him find out.

They can tell you its not allowed...But if they don't tell you to begin with then it's fair game unless in the lease, but if they find it they can probably make you remove it and you don't want to lose all your crops. So, like he said tell them.

As far as how likely...Well, my friend doesn't grow or anything, but his landlord gives a key to the bugman for him to come spray and he wasn't aware that this was part of the lease...He found out one day when he was asleep and the dude busted in. So, be sure you know if he has things like this in the contract before you start. Just okay it with him.

i recently moved to colorado and my lease says i cant grow or even USE medical marijuana on the premises. (the way i see it is that section is null and void due to legalization, and the lease needs to be rewritten if they dont want plants in their apartments) but the leasing people told me i could smoke. they told me i couldnt grow, but right after that, one of them gave me "the look" and basically said, you can do what you want, just dont tell people or be obvious about it, and dont fuck up the apartment.

i'm sticking to my 3 plant flowering limit. i use a grow tent, and the only alteration i've done to the apartment is add a window AC unit in the room the tent is in.

a cop came to my house the other day to investigate a crime, told me he could smell my plants, was asking about them. I didn't give him any info, and that kind of upset him when i wouldn't talk about it. He was like "i can get a warrant" and i was like 'Im sure you could".. and he finally said "well, were gonna see what the office thinks about it".. and i said "they know what goes on in my apartment".. (one maintenance man saw my plants when i was out of town, hes cool with it)

but he did tell the office, and i got a letter from thm, 10 days to vacate or clean up smell/ventilation in windows... the notice was very through, went into "just because its washington, still illegal at the federal level, blah blah blah, no using or even storing grow lights in the apartment..."

The women in the office took this cops report verbatim and put it in a notice.

i called the property manager who was cool about it (he just signs things, doesn't read them).. said "hmm, isn't that legal now?... just dont want to make it appear that your growing... etc... " and he dropped the $35 fee for receiving a notice.. nothing major happened from it, but a very close call nonetheless.

Yeah they can not put anything in the lease, and still not allow it, and kick you out and you wouldn't be able to do anything, cuz they'll say Fed Law and there's nothin u can do.
