if cannabis is authorized for medical use and u have a job that drug tests for drugs can u get fired if you are in compliance? even if the job is regulated by the FDA and the state and federal gov?

i dont see how they could fire you, i mean places test for benzos but if your proscribed your in the clear

yes they can fire you beacuse state law is direct opposite of federal law according to all ive read

yes they can fire you. wal-mart did just that not too long ago.

Benzos aren't a schedule 1 narcotic like cannabis. There is no such thing as a prescription for marijuana.

It actually went to the supreme court iirc and they ruled, yes they can fire you.

Even if Cannabis is made completely legal I'm still thinking they could fire you because you arent allowed to be drunk on the job. So why would you be allowed to be high on the job?
I mean yeah you might have smoked a month prior but still.

i never smoke on the job tho. haven't finished school for this pharm-tech job tho so im trying to find out whats up.

Yea thats teh key ^^ Having a dirty piss test != to being stoned on the job. I bet if it gets legal this would change.

But what Mr.Kite says is true too. Booze is legal but you can not do it on the job so even if they legal the bud. They need to come up with a test to show if you are high at that moment. I have extra body fat so
I am one of those that needs about a month free of it to pass pre-employment test, I know people who only smoke on weekends, one of them got hurt(you get hurt on job you have to piss in cup) they got a 6 week unpaid vacation and had to pe in cup to come back and told if it ever comes up dirty agn they would be fired. This person was not stoned on the job but it made no difference to the company(more so no difference to the companies insurance policy)

I will tell you with 100% certainty that yes, you can/will get fired. The California supreme court heard a case a few years ago on this issue. I think it was an AIDS patient who tested positive and got fired. I think he filed for wrongful termination, but the court said that employers can terminate an employee on the basis of a positive drug test for cannabis, even if they have gone through the proper protocol in obtaining said license. It's just something we will have to deal with, for now. Let me find the case...

well thanks for the info guys. i have already cut way down on my smoking habits. u guys are lucky that you dont live here in western pa cous if im not mistaken an employer around here can and will fire you for what ever they please, but the catch 22 on that 1 is they CAN NOT give u a bad reference. unless you were fired for theft they can not say he was not doing his job. they can say it was not working out between us but nothing more negative then that. i guess i will be not smoking every week anymore. maby once a month. if im lucky. looks like boos and pills will be my friend now. ugh it makes me sick cous i dont like to drink but i like to get buzzed. but they cant take the high i get from growing away. at least my wife will enjoy the fruits of my labor.
