My older brother is sitting in a California county jail with two felonies. His bail is set at $35,000 for "giving away" an undisclosed amount of marijuana. He has been there since Friday and I can't get anymore info than that. The last time we talked (about three weeks ago) he was traveling around the east coast. He is definitely not the criminal type nor is he interested in making money. Does anyone know why giving away some pot would result in a double-felony?

they stack on charges in the beginning. probably got him for possession AND distribution.
if that's the case, that he gave away a bunch of weed, then he'll go to court and depending on how good the attorney is, one of the charges will be dropped.
if he has a public defender, say goodbye for a short time. (maybe, idk cali laws...)

Yeah, no private attorney and no family in California. It's unlikely he was selling it and from what I could gather it was less than a felony amount in my state. I don't have many details, though. It was only a 3 minute conversation and it's impossible to call back.

Wtf, how can you charge someone for that.
What if it fell in your damn lap and you're like "OMFG I dont want this, somebody please take it!"... just as an example.

I honestly don't know. I have never heard of someone getting arrested for this. The only thing I could think of would be that it's regulated and you need a license to do that. Still, what the fuck?

Under Cali law giving away 1 oz or less is a misdemeanor. Giving it to somebody under the age of 18 is a felony. There is more going on then him just giving away weed.

For sure. Weed might not be legal here but people certainly don't go to jail for it, cops don't have the time or the jail space for that.
I guess it could be because the other person was a minor, either that or he "gave away" a couple pounds.

Just giving it away still follows under distribution to my understanding. So he'll likely be charged the same as if he sold it.

I reckon anything is possible and I'm sure he wouldn't incriminate himself using a jail phone. I'll let you know more when I talk to him again. It was just a three minute call and he only knew that his court date is "sometime this week".

I wish that was an option but there is no way we can afford it. I don't even think he's been in Cali for more than a week. Hopefully they have good public defenders out there.

fuck i hate dealing with charges. here in canada you get remanded like 5-10 times before anything. this way the lawyer gets paid a shitload. and it wastes like 6 months of your time
