Marijuana will not be legalised in Luxembourg, despite patients already benefiting from drug therapies based on cannabinoids.

Déi Gréng deputy Jean Colombera returned to the question of whether the Grand Duchy 'needs' to legalise the use of medical marijuana in a parliamentary question yesterday (Thursday). Minister of Health, Mars Di Bartolomeo, reminded him that "cannabis and cannabinoids are provisions to the amended Law of 19 February 1973 concerning the sale of medicinal substances and the fight against addiction."

But, he argues that Sativex and Marinol, two treatments derived from cannabis, can be used and prescribed in Luxembourg in accordance with their instructions, and must be ordered by a doctor through a special 'pink book'. Mars Di Bartolomeo further emphasised that "any patient can receive treatment initiated on the basis of an order in proper form, which meets the statutory criteria."

The Déi Gréng member suggested that Luxembourg should align with the French law which permits temporary use of pharmaceuticals not covered by an authorisation on the market. The minister replied that this system applies only to pharmaceutical specialties and not the raw materials (powder, herbs...).

Noting that the 'emporary use' rule has been granted only for very limited number of patients requiring marinol and not at all for those wanting Sativex, Mars Di Bartolomeo estimated that at present "patients in Luxembourg benefit from equivalent access to treatment with cannabinoid medicines as French patients."
