 hmmmm sneaky ipod warranty question

So my last night in Denmark I fell asleep at the station at 5 in the morning waiting on my train listening to my ipod, I wake up and it's been stolen straight out of my pocket along with my phone, seriously shocking considering there were so many people standing around me I remember, oh well that's besides the point.
I bought the iPod at best buy with a 2 year warranty where if anything should happen to it I can return it for a new one absolutely free, I already did this once.
Well now that I don't have it, I was considering buying a broken or used one over ebay and returning it in the original box I got it in to best buy and was wondering if they'd just completely ignore the fact that it's another one or that they'd check the serial number on the back of the pod, any opinions?

im pretty sure theyd check the serial # but u can try it and if they wont take it at least ull have an ipod

i've returned a used ipod without the headphones before and got a refund. that was at wal mart though  idiots
